Administrative Monetary Penalty System

The Town of Tecumseh is starting a two-year trial program called the Administrative Monetary Penalty System ("AMP System"). This system will replace the current court process for minor by-law and parking offences with a faster and more customer-friendly way to pay fines or challenge them.

Going to court for small disputes can be stressful, slow and inefficient. With Tecumseh's AMP System, these issues will be handled locally at Town Hall by Screening and Hearing Officers, who can adjust, cancel, or confirm penalties. This change helps keep the courts less crowded and provides a simple and accessible system for everyone in Tecumseh.

Paying Your Penalty

Payment can be made in person at Town Hall, located at 917 Lesperance Road, Tecumseh.

Payments are due on or before the 15th day following the Date of Issue. For example, if your Date of Issue is January 1st, then your payment is due before January 16th. Late payments or NSF (non-sufficient funds) payments will be subject to Administrative Fees as set out in the Town's Administrative Fees and Charges By-Law

When attending Town Hall to make your payment, please ensure you bring your Penalty Notice/ticket (or review decision, if applicable) and photo ID with you.  Payments can be made by cash, debit or cheque. Credit is not accepted for these payments at this time.

Under the traditional Provincial Offences Act system ("POA"), resolution of these matters can be intimidating and lengthy.  The Town's AMP System is being introduced to allow the Town to address parking and minor by-law infractions from start to finish with the following benefits:

  • matters are resolved in a more convenient and citizen-friendly environment.
  • you are able to continue to exercise your rights through a process established in the AMP System By-Law, including the right to request a review of the matter or appeal a review decision.
  • you are provided an opportunity to request an extension of a deadline in applicable circumstances.
  • you are able to avoid the congested timeline of the Courts.

Penalty Notices are issued by either a Tecumseh By-Law Enforcement Officer, Firefighter or OPP Officer by:

  • attaching the Penalty Notice to your motor vehicle for motor vehicle related offences; 
  • directly giving it to you at the time and place of the offence;
  • personal delivery to you as soon as reasonably possible following the date of the offence;
  • delivery by registered mail to your last known address (Date of Issue to be deemed the 7th day following the post date of the registered mail).

Option A: Pay the penalty amount and related administrative fees/charges, if any.

At this time, to attend to payment you will be required to either:

  • attend Town Hall at 917 Lesperance Rd., Tecumseh during regular business hours to make payment by either cash, debit, or cheque/money order payable to the "Town of Tecumseh".
  • mail a cheque/money order (do not mail cash) to: Town of Tecumseh, 917 Lesperance Rd., Tecumseh, ON N8N 1W9.

Please Take Notice:

  • payment is required by the 15th day from the Date of Issue of the Penalty Notice whether payment is made in person or by mail. Failure to deliver payment by the deadline may result in further fees and charges to you (i.e., Late Payment Charges)
  • it may take up to 48 hours for your Penalty Notice/ticket to be entered into the Town's AMP System and therefore you are required to bring your Penalty Notice/ticket with you when attending in person to make payment
  • any payment declined by your financial institution will result in the Town adding NSF fees and/or other charges to your penalty pursuant to the Town's Fees and Charges By-Law
  • you may be required to show ID

Option B: Dispute your Penalty Notice

Within 15 days of the Date of Issue noted on your Penalty Notice/ticket, you may commence the process to dispute your Penalty Notice/ticket by first either:

  • submitting a Request for a Screening Review,

Or;

  • submitting a Request for Extension of Time to Request a Screening Review.

Either request may be completed online through the forms linked on this page or by contacting the Town by telephone at (519) 735-2184 or in person at Town Hall, 917 Lesperance Rd., Tecumseh.

Every Penalty Notice will have a "Date of Issue" clearly noted on it.

To dispute your Penalty Notice, you must complete and submit either a "Request for a Screening Review" or a "Request Extension of Time to Request a Screening Review" within 15 days of the Date of Issue. In the event an extension is requested and granted, you will then be required to complete and submit a "Request for a Screening Review" within the given extended timeframe.

Once you have submitted the "Request for a Screening Review" a confirmation email will be delivered to you and you will be emailed with a Screening Review date.

Please Take Note:

The Screening Officer is authorized to make Screening Decisions on behalf of the Town of Tecumseh. Screening Decisions may only be appealed as set out in the AMP System By-Law

You are responsible for bringing a person to assist you during your scheduled Screening and/or Hearing Review, including all costs related thereto. The Town does not provide interpreters.

Under extenuating or extreme circumstances (such as death or illness), you may be granted an extension of the deadline to request a Screening Review. The decision to grant an extension relies solely with the Screening Officer. You may submit documentation to support your request. For further details of the process, please see above "I want to dispute my Penalty Notice. How do I do that?".

If you don’t show up for your scheduled Screening Review or Hearing Review, it will be assumed that you agree with the Penalty Notice/ticket or Screening Decision, as the case may be. Additional administrative fees, like charges for missing your review, may be added to the amount you already owe.

In addition, the amount owing may be sent to the Ministry of Transportation (MTO) for collection or added to the Tax Roll for the property to which the Penalty Notice was issued for collection with your Property Taxes.

If you have received your Screening Decision and you do not agree with it, you may request for an appeal of a Screening Decision by a Hearing Officer. Decisions by the Hearing Officer are final - there are no other forums for dispute. For further information please see "Step 2" above under the heading "AMP System Dispute Process".

Yes. You may authorize another person to act as your representative during a Screening Review or Hearing Review. You must complete the Authorization to Act as an Agent form and the person must bring the signed and completed form and valid government-issued ID with them to the Review.

If you received an Overdue Notice for a parking or by-law Penalty Notice/ticket, this means the Town has not received payment or you have not requested a Screening or Hearing Review within the required timeframe. You are no longer eligible to request a Screening or Hearing Review and must take action to avoid incurring additional Administrative Fee(s), including Late Payment charges. If you fail to take action, you risk your Penalty Notice and any additional Fees/Charges being added to your Tax Roll or sent to the Ministry of Transportation (MTO) for collection. Both of the latter actions are irreversible, and you will either be required to pay at the time you renew your vehicle's plates, your licence, or pay with your Property Taxes.

If you do not choose one of the options listed on the back of your Penalty Notice, the Town assumes you have decided not to dispute it. You may be required to pay additional administrative fees/charges. Additionally, if the Penalty Notice and Administrative Fees/Charges remain unpaid, the Town may take action to ensure collection such as sending the fees to the Ministry of Transportation (MTO) or adding the fees to your Tax Roll.

Under specific circumstances Administrative Fee/Charges may be applied to your total amount due. For example, Administrative Fees are applied for late payments, failure to attend a scheduled Screening Review or Hearing Review, and Ministry of Transportation (MTO) searches and submissions. You will either be required to pay the original Penalty and any additional Administrative Fees/Charges at the time you renew your vehicle's plates, your driver's licence, or pay your property taxes.
